1. Acceptance of Terms

By creating an account or using any part of the Bekah platform — including bekah.ai, order.bekah.ai, staff.bekah.ai, and pos.bekah.ai — you agree to these Terms. If you do not agree, do not use the service.

Bekah is currently in a pre-launch MVP phase. Features and terms may change with reasonable notice.

2. Description of Service

Bekah provides an intelligent store operating system comprising three layers:

• AI Staff — a multilingual virtual ordering agent accessible via QR code
• Smart POS — a lightweight point-of-sale management system
• Open Payment — a payment orchestration engine supporting multiple payment methods

The service is designed for merchants and business operators. End customers (guests placing orders) use AI Staff without creating an account.

3. Accounts and Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@bekah.ai if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

4. Merchant Obligations

As a merchant using Bekah, you agree to:

• Provide accurate menu information, pricing, and availability
• Fulfill orders placed through the platform promptly and as described
• Comply with all applicable local laws, tax regulations, and food safety standards
• Not use the platform for any unlawful or prohibited purpose
• Keep your settlement bank account information accurate and current

5. Payments and Settlement

Bekah processes payments on behalf of merchants through its Open Payment engine. Net proceeds — after applicable transaction fees — are transferred to your nominated bank account on a T+1 cycle (next business day), subject to the terms of any applicable payment provider.

Bekah is not a bank or financial institution. We do not hold funds beyond the settlement cycle. All transaction records are maintained in a verified ledger and are available in your dashboard.

Transaction fees are disclosed at the time of onboarding and may vary by payment method and merchant tier.

6. Intellectual Property

All content, design, software, and technology comprising the Bekah platform is owned by JCG Inc. or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the platform without written permission.

You retain ownership of your store data (menus, orders, customer interactions) and grant Bekah a limited license to process and display that data for the purpose of operating the service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, JCG Inc. shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform. Our aggregate liability shall not exceed the fees paid by you in the three months preceding the claim.

Bekah is provided "as is" during the current MVP phase. We do not guarantee uninterrupted or error-free service.

8. Termination

Either party may terminate this agreement with 14 days' written notice. We reserve the right to terminate immediately for material breach, fraudulent activity, or violation of the Prohibited Content Policy. Upon termination, you remain responsible for any outstanding obligations, and we will process any pending settlements.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which JCG Inc. is registered. Disputes shall be resolved through good-faith negotiation first, and thereafter through binding arbitration or the courts of that jurisdiction.
